Owning the Future Before it Arrives
How AI Turns Property Data into Insider Advantage
Housing isn’t just built anymore. It’s predicted.
The deepest divide in today’s property market isn’t between buyers and sellers - it’s between those who see the data first and those who don’t. This is the new information divide: they see the tide turning before we notice the swell.
Developers and property funds now fuse datasets that were once public commons - land registries, planning overlays, demographic forecasts, even scraped sentiment from real-estate portals and local community Facebook pages. Their models search for “FOMO signals”: chatter about full schools, café openings, or new rail stops that hint a suburb’s moment is near.
Machine learning turns this local noise into foresight - predicting when to buy, when to list, and when to hold. What insider trading once was to equities, predictive analytics has become to land.
The result isn’t a conspiracy; it’s the quiet evolution of informational advantage. Unlike a homebuyer who sees one listing at a time, institutional players see the entire chessboard. Algorithms simulate thousands of futures, modelling how to stage releases, drip-feed supply, and manage price expectations. Every property cycle becomes a slow-motion data trade.
In the United States, the shift is even clearer. As one analyst put it, “OpenDoor is no longer just a home-flipping platform - it’s becoming an AI-driven marketplace reshaping how homes are sold and marketed.” At the centre of this reinvention is what Yahoo Finance calls “an AI-powered pricing intelligence engine, trained on millions of photos, agent notes and home-visit records.”
In effect, these finely tuned valuation models are trained to find the rent gap - the difference between what a home is worth now and what it could fetch after light renovation, good timing, or a neighbourhood mood swing. The seller gets liquidity; the platform captures the curve. When predictive algorithms can model not just price but momentum, the potential to game the system has never been higher.
AI has magnified the value of such data exponentially. Victoria’s land titles office was privatised for AUD $2.9 billion in 2018. Last year, the total value of Victorian land rose by about AUD $70 billion - roughly 60 per cent of its usual annual increase, partly due to the land-tax reforms I helped introduce. Even based on a moderated estimate, if roughly a third of that uplift flowed as returns to property investors, the registry’s privatisation has been an extraordinary boon for the investment class.
What’s changed is not just ownership of the registry, but the velocity of its value extraction. Once a civic record-keeping system, it has become a predictive asset - the raw feed-stock for AI models that anticipate and monetise shifts in value before they appear on the public ledger.
The algorithmic era hasn’t yet proven that information rents can sustain the returns of land, but the market is already trading as if they can.
Just as Goldman Sachs colocated its trading infrastructure to shave milliseconds off execution, property platforms now sit closest to the exchange of land itself—every title transfer, every valuation, every council dataset.
The advantage isn’t measured in milliseconds but in months - the lead time before the rest of the market even knows where demand is heading.
In Australia, the Australian Bureau of Statistics already uses automated scraping to publish rental-market data monthly. Meanwhile, investors treat digital infrastructure - data centres, edge-compute land, and network corridors - as the next great property play. The line between owning land and owning the data that defines its value is dissolving.
Yet when these risks were raised, the National Housing Supply and Affordability Council refused even to entertain the discussion - a telling omission from an institution charged with stewarding transparency in housing supply.
Regulating the New Information Divide
In equity markets, the rules are crystal clear: trading on material, non-public information is illegal. Companies are barred from whispering to select investors under Regulation FD in the U.S., and algorithmic traders face mandatory audit logs, circuit-breakers, and kill-switches under the EU’s MiFID II and Australia’s Corporations Act.
Housing markets, by contrast, run on data ecosystems that are almost entirely unregulated - even as AI supercharges their predictive power.
Similar predictive-valuation models are emerging across global proptech - from Zillow’s brief flirtation with algorithmic home-flipping, to the UK’s rapid adoption of AI for property valuations and site selection - to Australia’s early experiments with automated buyer platforms - they are all chasing the same informational edge.
Taken together, these models function like a derivative trade on housing sentiment: they monetise timing itself - offering liquidity today in exchange for a share of tomorrow’s upside.
The analogy to insider trading isn’t rhetorical.
The deeper question - and one regulators haven’t begun to test - is whether the major developers and funds are now drawing from the same algorithmic weather system.
When auction clearance rates soften, days on market lengthen, or wage growth and credit availability tighten, the models may all issue the same signal: pull supply, pause listings, sit on land.
If that feedback loop proves true, then AI isn’t just predicting the market - it’s synchronising it.
The result is less competition, slower supply, and a form of collusion without conversation - a pattern of behaviour that financial regulators would instantly recognise.
In my Staged Releases dataset, supply across nine master-planned communities fell 48.4 per cent (see graph above) even as auction clearances and credit conditions softened - a moment when classical economics would expect developers to release more lots to maintain sales and cashflow. Prices, however, kept rising. The data hints at something deeper: a coordinated algorithmic reflex - visible even in 2017 - where developers’ models responded to shared signals not by competing for buyers, but by tightening supply just as prices climbed.
What would have to be proven
Whether by privileged access or shared algorithms, proving deliberate market advantage is the hard part.
To call it insider trading-style behaviour, property regulators would need to show:
Materiality - that the information would be likely to move prices or decisions if it were available to everyone.
Non-public or non-competitive status - that the data or model outputs weren’t reasonably available, or that market participants were acting on synchronised signals that effectively removed competition.
Use and benefit - that actors exploited it for timing, acquisition, or pricing decisions.
Causality - that data logs, model runs, or internal notes link the advantage to that information.
Right now, no agency anywhere in the world is set up to test those elements in property markets. In finance, the Australian Securities & Investments Commission or the U.S. Securities and Exchange Commission can subpoena trading records and algorithmic logs. In housing, there’s no equivalent dataset, no mandated disclosure, no audit trail.
The data barrier: unequal access by design
In Australia, once public property data is priced like a luxury good.
Accessing core macro datasets - land titles, transaction histories, valuation overlays - typically costs $3,000 to $6,000 per spreadsheet per annum, depending on the jurisdiction.
For NGOs, community-housing providers or small councils, that’s prohibitive. For universities, these licensing regimes collectively cost millions each year just to access the raw materials of analysis.
Meanwhile, the same data is a rounding error for institutional property funds, banks, or proptech firms.
The result is a systemic research blackout: those with the greatest stake in housing equity have the least access to the information that shapes it.
It’s not a data marketplace; it’s a moat.
Steps forward for regulators
Define “material housing information.”
Identify classes of data that move value — not only rezoning decisions, infrastructure tenders, and public-subsidy allocations, but also significant supply contractions across one site or many, particularly when they coincide with looming infrastructure rollouts or shifts in market sentiment. Such patterns should be treated as sensitive disclosures, requiring transparency when detected.Apply a fair-disclosure rule to planning.
If any such data is shared with one developer or consultant, it must be made public at the same time - the planning equivalent of Regulation FD.Govern housing algorithms like trading algorithms.
Require registration, governance frameworks, audit logs, and independent testing for large-scale valuation or pricing models.Create suspicious-activity reporting for housing platforms.
Borrow the financial-market template: mandate that portals or major developers report anomalous listing or withdrawal patterns around major announcements.Mandate open, affordable property-data access.
Treat core registries and planning datasets as civic infrastructure, priced at marginal cost. The rule of thumb should be: if the public paid to collect it, the public shouldn’t pay again to see it.Audit the algorithms.
Annual independent reviews with public summaries of inputs, fairness checks, and distributional impacts - the housing equivalent of financial “algo control” audits.
Why it matters
Financial markets spent decades building guardrails because who knows first wins.
Housing is slower but far more consequential: it anchors national wealth, household debt, and the social contract itself.
AI-driven foresight has turned property data into a private advantage - a kind of economic radar, scanning the future before the rest of us even know it’s there.
The better the data, the more accurate the model; the more accurate the model, the more valuable the underlying data becomes. It’s a self-reinforcing circle where prediction itself becomes a tradable asset.
The coming quantum era will intensify this. Quantum infrastructure will cluster around major research universities, stable-energy hubs, and national labs - Boston, Munich, Tokyo, Sydney. Real-estate groups are already mapping these “quantum corridors” the way rail barons once mapped stations. Algorithms won’t just predict growth; they’ll generate it.
If foresight has become a commodity, then fairness must become a right.
As part of that cultural shift, we must protect our communities by building what the markets can’t: shared ground through Community Land Trusts, open data that belongs to everyone, and the universal right to live without debt as destiny.
As one supporter told me, she would never sign away her freedom for a $900 000 mortgage - and that, perhaps, is the quiet revolution already underway.
In a market where foresight is monetised, fairness depends on who has the future on file.
